Apple/iTunes problem

What happened:
My hard drive died so I had to get a new one. I managed to copy everything off of the old one. When I got the new one and set it up I had to re-install everything (fair enough). I copied back over what I could (music, films). I tried to sync my iphone and ipod but the contents will be erased, even though I transferred the purchases. Now with the new iOS 5.0 all apps will be deleted off of the ipod and iphone if I update. I'm fed up of apple being useless and getting rid of your stuff without being able to transfer it unless you bought it, and even if you did it has to be erased to sync with what it calls a new library.
Is there anything I can do to save my data?
I'm really thinking of getting a new phone that isn't apple. Any reccomendations?

I just did my new 5.0 update and it didn't delete any of my apps, books or music, and some of which aren't synced with my laptop itunes. The only thing it did do was restart my phone and add in the icloud option and 2 new (very stupid) mandatory apps. I know how awful it is to loose everything in a sync! its happened to me a few times, I always have my husband back up my music outside of itunes on my laptop and also to our external hard drive (that we went out and bought after everything was erased the last time, lol) He found some way to "crack" our ipod touches and my iphone so you can save your music to your hard drive but it is converted to regular music files and not itunes. Maybe you can try backing up your music and files on your itune account. If you want I can ask my hubby about the program he uses when he gets home from work later :S
